1. scope of application
1.1 These General Rental Terms and Conditions (hereinafter "GTC") of Sport Laurin KG of Näckler Anna & Co., Karerseestraße 12, 39056 Welschnofen (Italy), apply to all rental contracts for sports equipment concluded via the website www.sportlaurin.com/online-reservierung/ or via Skidelivery (www.skidelivery-dolomites.it/) as well as on site.
1.2 Sports equipment includes, in particular, skis, snowboards, ski boots, helmets, protectors, mountain bikes, e-mountain bikes, climbing equipment and other items of equipment.
2. conclusion of contract
2.1 The offers presented on the aforementioned websites represent a non-binding invitation to make a reservation. The contract for the hire shall only be concluded upon confirmation by Sport Laurin KG.
2.2 The customer can make a reservation using the online form on the website. By submitting the reservation, the customer submits a binding offer to conclude a hire contract. The hire contract is concluded as soon as the customer receives a booking confirmation by e-mail or - in the case of short-term bookings - by collecting the equipment on site.
2.3 When booking via www.sportlaurin.com and on site, payment is made on site on collection. When booking via www.skidelivery-dolomites.it/ different terms of payment may apply; these are shown separately in the respective booking process.
2.4 The contract language is German or Italian.
3. rental object and categories
3.1 The sports equipment that can be reserved via the websites includes, among other things
- Ski: Easy Carving, Allround Carving, Excellence Carving, High-End Class
- Children's skis: 70-110 cm, 120-150 cm, Junior
- Snowblade, snowboards (incl. children's models)
- Toboggan, snowshoes
- Ski boots, snowboard boots
- Back protectors, helmets
- Mountain bikes, e-mountain bikes (fully, hardtail, children)
- Via ferrata sets, child carriers
3.2 The products shown in the online reservation system are sample models. The actual selection of models is subject to availability upon collection at the store. Sport Laurin guarantees that the customer will receive an item from the reserved category or a higher-quality alternative.
4 Prices and terms of payment
4.1 All prices quoted are in euros and include the statutory VAT applicable at the time of booking.
4.2 Payment is always made on collection on site, unless otherwise stated in the booking process.
4.3 A refund of rental fees paid is only possible in exceptional cases and after individual examination (in the event of illness with a medical certificate).
5. duties of care and liability of the customer
5.1 The customer undertakes to use the rented material exclusively as intended and with care. Disclosure to third parties is not permitted.
5.2 The customer is advised that there is a considerable risk of injury, particularly in the event of unauthorised changes to the binding settings or the bike saddle. Swapping skis/snowboards or bikes between hirers without authorisation from the staff is expressly prohibited.
5.3 The customer must ensure that the hire equipment is stored safely to prevent theft or confusion. Insurance is not included in the hire price.
5.4 In the event of loss, theft, gross damage or improper use, the customer shall be liable for the repair costs or for the replacement value (current value) of the item concerned.
6. return
The material must be returned by close of business on the agreed return date. Late return may result in an additional charge.
7 Cancellation and rebooking
7.1 The customer may cancel a reservation up to 48 hours before the planned start of the rental period cancel or rebook free of charge. The cancellation must be made in writing (by e-mail).
7.2 In the event of cancellation less than 48 hours before the start of the rental period or in the event of a no-show, a cancellation fee of 50 % of the rental price will be charged unless there is a valid reason (illness with medical certificate).
7.3 Rebookings are possible subject to availability and after consultation with Sport Laurin. There is no entitlement to certain models or categories when rebooking.
7.4 Online payments already made will be refunded in full if the cancellation is made in good time. The refund will be made using the same payment method that was used for the booking.
8 Applicable law and place of jurisdiction
All legal relationships between the customer and Sport Laurin KG shall be governed exclusively by the law of the Republic of Italy.
The place of jurisdiction for all disputes arising from this contract is - insofar as legally permissible - the competent court in Bolzano (Italy).
9. alternative dispute resolution
9.1 The European Commission provides a platform for online dispute resolution (OS), which can be accessed at https://ec.europa.eu/consumers/odr is available.
9.2 Sport Laurin KG is not obliged and in principle not willing to participate in dispute resolution proceedings before a consumer arbitration board.
